Protection of Personal Data

The Law on Protection of Personal Data No. 6698 was published in the Official Gazette on 7 April 2016 and entered into force. In 2010, the Protection of Personal Data was also guaranteed by the Constitution, prior to the current effective law within the scope of personal data. Although personal data is included in the scope of the said law, the definition and scope of personal data is important. As the law states, "kişilerin temel hak ve özgürlüklerini korumak ve kişisel verileri işleyen gerçek ve tüzel kişilerin yükümlülüklerini ve işbu yükümlülüklere nasıl uyacaklarını” düzenler. Kişisel veri tanımı oldukça geniş olmakla birlikte mevcut her verinin ihlali kanun kapsamına girmemektedir. Bu hususa göre,

• Names and surnames of persons,
• Republic of Türkiye identification numbers,
• Personal phone numbers, fingerprints,
• Blood groups,
• E-mail addresses,
• Addresses of their places of residence,
• Bank account information and bank iban numbers,
• Family information, CVs of people,
• Some examples, such as photographs of people, images and sound recordings, fall under the scope of personal data.

The stated ones are only a few examples within the scope of the law, and it is possible to expand these examples. Within the scope of the protection of personal data, legal support is required in order to ensure the security of the data and to prevent the occurrence of risks.
